October, 2025 - China Special Port Charges on US Ships: FAQs

On 10th October, 2025, the Ministry of Transport of China announced that ‘Special Port Charges’ (the “Charges”) would be levied against US ships calling at Chinese ports from 14th October, 2025. The Chinese Ministry of Transport subsequently released the ‘Implementation Measures on the Special Port Charges for Vessels’ (the “Measures”) on 14th October, 2025.

October, 2025 - The Lila Lisbon: Court of Appeal holds that loss of bargain damages are recoverable under Saleform 2012

In Orion Shipping and Trading LLC v Great Asia Maritime Ltd (Lila Lisbon) [2025] EWCA Civ 1210, the Court of Appeal, reversing the Commercial Court decision in August, 2024, held that a buyer can recover loss of bargain damages under clause 14 of the Saleform 2012 in the event of “proven negligence” by the seller.

By way of update to our July article, the lower price cap has now come into force in the UK and EU, such that for any trades with an effective date of contract after 23:01 (BST) on 2nd September, 2025 the new price cap of $47.60 will apply.

The Commercial Court’s decision in Tonzip Maritime Ltd v 2Rivers PTE Ltd [2025] EWHC 2036 (Comm) examined whether a shipowner was entitled to refuse to load cargo based on sanctions concerns, and whether its reliance on a sanctions clause was objectively reasonable. The ruling provides guidance on the interpretation of sanctions clauses, the evidentiary burden on shipowners, and the limits of commercial discretion in the face of geopolitical risks and deceptive shipping practices.
